Some Tax-Exempt Organizations Receive Erroneous IRS Penalty Notices; Abatement Available

Some tax-exempt organizations have reported that they have received penalty notices from the Internal Revenue Service (IRS) for late filing of Forms 990, 990-EZ, 990-PF, and 1120-POL despite receiving an automatic extension and complying with IRS instructions to file during March.
 
The automatic extension was granted because the IRS’s e-filing system was unavailable for these forms from January 1, 2012 through February 29, 2012.  Notice 2012-4 granted the extension until March 30, 2012 for organizations that normally have filing deadlines of January 17th or February 15, 2012.  The extended deadline applied to all organizations, even if they were not required to file electronically.  

The IRS notified complying organizations via email that they may request penalty abatement in accordance with Notice 2012-4 by contacting the IRS at (877) 829-5500.
